Abstract

In a jurisdiction where the national legislation lays down only broad principles and where there is not yet an established and reliable court reporting system, the various explanations, interpretations or notices published by the Supreme People’s Court become a useful supplementary aid. This article looks particularly at those SPC rules touching on the validity of arbitration clauses and the enforcement of arbitral awards and identifies areas where further judicial explanations or interpretations would be welcome.
