SUPERIOR AUTHORITY AND FRAUDULENT IN PROCUREMENT OF GOODS/SERVICES: THE ROLE OF CODE OF ETHICS

An increase in the number of corruption cases in the goods and services procurement at government agencies in Indonesia causes the country to suffer significant losses. This condition proves the noncompliance of the goods and services procurement officials with the code of ethics for the implementation of goods and services procurement. Corruption cases in the goods and services procurement tend to involve goods and services procurement officials, both as Budget User Authorities, Commitment Making Officials, and Technical Implementation Activities Officials. In other words, officials (superiors) use their authority to commit fraud in the goods and services procurement. The purpose of this study is to determine and evaluate the role of the code of ethics on the influence of superior authorities on fraudulent acts in goods and services procurement of government agencies in Indonesia. This study used the laboratory experiments method with the accounting students of Pattimura University, Ambon as the participants and a two-way ANOVA with a 2x3 factorial experimental design as a data analysis technique. The results of this study show that superior authority plays an important role in influencing the occurrence of fraudulent acts in the goods and services procurement, and a code of ethics can reduce it. There is a difference in the tendency to commit fraud in the goods and services procurement when there is a superior authority and no superior authority. The tendency to commit fraud will be smaller for individuals who are asked to read the code of ethics and signatures it compared to only reading the code of ethics and without a code of ethics.

Changes in the world's landscape with massive digital developments affect learning and development strategies of human resources in every organization, including the Government Agencies. In Indonesia, changes in ASN competency management as mandated by the Law on ASN also encourage changes in the learning and development process in education and training units, marked by the emergence of Corporate Universities in Government Agencies. Using the concept and generic strategy approach of Corporate University developed by Radermarkers (2014), this research intends to analyze the learning strategies developed by Corporate University in Government Agencies in Indonesia. The research method is carried out with a literature study approach with data and information from the Corporate University strategic plan as the main data source. From the analysis of concepts and strategies for six Corporate Universities, it can be concluded that the school strategy is the strategy chosen by the majority of Corporate Universities in Government Agencies, compared to the college strategy and the academy strategy. Various concepts and strategies of Corporate University in this research are expected to reference other Government Agencies that will develop Corporate University as a strategy in developing ASN competencies in Indonesia.

Relationship between public procurement governance and the performance of government agencies in Indonesia

The Government Goods/Services Procurement Policy Institute (LKPP) established a policy for measuring the procurement governance index (ITKP) for Government Agencies in Indonesia as one of the tools to achieve a "Clean and Accountable Bureaucracy." This study explores the relationship and significance of ITKP indicators with government performance, as measured by the Government Agency Performance Accountability Report (AKIP). This study uses a quantitative method with secondary data obtained from LKPP and the Ministry of PANRB for the 2020-2023 period. The research sample included 72 ministries and 402 local governments. The results showed that there was a positive and significant relationship between procurement governance and the improvement of the performance of Indonesian government agencies, both in Ministry of Ministries and Agencies, Regional Governments, and the entire sample. The findings can be used as feedback and evaluation for future policy improvements, including the use of the procurement system, the qualifications and competencies of PBJ human resources, as well as the maturity level of UKPBJ.

The mediating effect of fraud awareness on the relationship between risk management and integrity system

PurposeGovernment institutions in Indonesia have implemented an integrity system as a strategy to prevent fraud and corruption by integrating the risk management and organizational ethics. This integration is important to increase the awareness of fraud in the organization. Based on self-determination theory, this study examines the mediating effect of fraud awareness on risk management and integrity systems.Design/methodology/approachThe study was carried out by using a quantitative approach. The participants of the survey were auditors of the inspectorate of Ministries and Government Agencies in Indonesia. The number of respondents was 103 auditors. The hypothesis testing method used the partial least squares structural equation modeling (PLS-SEM) approach. The data were processed by using WarpPls 7.0 software.FindingsThere are two main results in this study. First, risk management directly affect the integrity of the system. Second, fraud awareness mediates the relationship between risk management and integrity systems.Practical implicationsThe result of this study implicates the policymakers in Ministries and Government Agencies in Indonesia to increase organizational fraud awareness through the involvement of internal audits with risk management. The fraud awareness will greatly improve the performance of the integrity system.Originality/valueThis is the first study examined fraud awareness of integrity systems and risk management. This study can enrich the literature on internal audits, especially the duties of auditors with risk management.

Analysis of the Implementation of Policy on Equalizing Administrative Positions to Functional Positions in Central Government Agencies

Equalization of positions from administrative positions to functional positions is one form of implementation of the policy of simplifying the bureaucracy into two levels in government agencies in Indonesia. This problem occurs because the equalization of positions is carried out in a relatively short time without being preceded by an in-depth study. This condition has an impact on the career uncertainty of functional officials as a result of the equalization which has an impact on the decline in employee performance and organizational performance. This study aims to analyze the process of equalizing administrative positions to functional positions in order to formulate inputs for improving the implementation of these policies in the field. The research method uses a qualitative descriptive approach. Research informants determined the snowball with key people Central Government Officials and related functional officials. Data was collected through observation, in-depth interviews and literature study. Data analysis techniques with data reduction, presentation and conclusion. The validity of the data using a triangulation technique of sources and data. This theory uses the theory of policy implementation. The results of the study indicate that the equalization of administrative positions to functional positions in government agencies needs to pay attention to communication factors, resources, dispositions and bureaucratic structures. Recommendations are in the form of policy proposals to improve arrangements for equalizing administrative positions to functional positions.

The implementation of probity audit to prevent fraud in public procurement of goods and services for government agencies

The procurement activities to obtain goods and services for government agencies in Indonesia are susceptible to becoming a medium of various types of fraud. Probity audit is a novel approach in which real-time audit is implemented in the process of goods and services procurement to overcome ongoing fraud issues. This study aimed to evaluate the implementation of probity audit with reference to applicable regulations. This research was a descriptive qualitative study analyzed using the document analysis method. The object of the study was the Inspectorate of the National Public Procurement Agency (LKPP) as the Government Internal Supervisory Apparatus of LKPP. The study results showed that, first, the suitability of facilities and infrastructure to implement probity audit was fairly good; second, the implementation of probity audit was satisfactory and in accordance with the guidelines for probity audit; third, the issue during the implementation of probity audit included the absence of policy and Standard Operating Procedure (SOP) for the implementation of probity audit in LKPP. This research was also expected to become one of the relevant sources for future researchers and assist the government in implementing the probity audit policy in Indonesia.

Policy on Empowering Women Victims of Violence: A Case Study at the Office of Women's Empowerment, Child Protection, and Population

This study aims to describe and analyze the implementation of policies to empower women victims of violence and identify supporting and inhibiting factors in implementing these policies. The research was conducted at the East Java Province Office of Women's Empowerment, Child Protection, and Population (DP3AK). The data collection techniques used were observation, interviews, and documentation. The data analysis technique in this study uses qualitative data analysis with the stages of data collection, data reduction, data presentation, and conclusions. The research findings show that the implementation of policies to empower women victims of violence in DP3AK East Java Province is carried out through the stages of assessment, planning, monitoring, implementation, and evaluation. A participatory approach is applied, but there are still challenges in coordination with districts/cities and participant selection. Supporting factors include collaboration, policy support, resources, and SIMFONI PPA. Barriers included superficial monitoring, less open coordination, budget limitations, and community stigma that affected the effectiveness of the training. The results of the study are expected to contribute to the DP3AK of East Java Province, especially in the Field of Women's Protection and Family Quality, as well as other government agencies in Indonesia in the implementation of programs to empower women victims of violence, as well as a reference for similar studies.

Inovasi E-Lampid Sebagai Implementasi New Public Service dalam Meningkatkan Kualitas Pelayanan Disdukcapil Kota Surabaya

New public service is a new model after new public management and as a service model that prioritizes the interests of the society. The implementation of the new public service has been implemented in several government agencies in Indonesia as a form of improving the quality of services provided by the government to the society. One of government agency that has implemented the new public service model is the Surabaya City Population and Civil Registry Service with the service process using the E-Lampid application. This application is an innovation created by the Surabaya City government and submitted to Disdukcapil to overcome the many queues of people who need population administration services. This study aims to explain the implementation of E-Lampid application in the city of Surabaya as part of the implementation of the new public service. This study uses a qualitative method by using data sources in the form of secondary data where the data obtained comes from previous studies such as literature, online news, scientific journals, government websites that are relevant and related to the topic of research discussion. The data analysis technique used a literature review study in the period 2010-2020. The results showed that the implementation of the E-Lampid application has overcome the problems that exist in the provision of public services in the Disdukcapil city of Surabaya. This application can be accessed by the people with online step, making it easier for the public to update their personal data information. This paper proposes The Use of KPI in Group Decision Support System Model of ICT Projects Evaluation at Local Government Agency in Indonesia. This study is a part of the attempt to improve local government performance in Indonesia, especially for Local Government Agencies (SKPD) involved in Decision Support System (SPK), which should be optimized through Information Technology. Different from the prior research, in this paper we try to describe how to determine KPI in an ICT project at local government agency and the applicable evaluation model. Generally, this paper will discuss how to make an performance indicator, so that the output of an ICT project product can result the expected outcome, benefit, and impact. Furthermore, it will be explained in regard to the Group Decision Support System (GDSS) evaluation model by considering the applicable legislation aspect, which facilitates decision makers such as: Government Institution Executives, ICT Managers Unit, Business Process Owner Unit, and Society represented by Regional House of Representative, to give assessment or evaluation upon the implementation of ICT Projects at Local Government Agency. As the research support, survey and interview have been conducted to stakeholders in decision-making. The proposed model is expected to be able to give ideas and solutions in evaluating ICT Projects done at local government agencies in Indonesia.

Many exposure of foreign languages, in this case is English, in daily communication could give significant impact towards oral and written language to the Indonesian speech community. That phenomenon was the result of language contact which is widespread in this digital era. This research aimed to identify English vocabulary which found in the caption on social media Instagram account of Ministry and Non-Ministerial Government Agencies in Indonesia. Data in this research were the English loanwords vocabulary and interference which are obtained by applying observation method with screenshot and note taking technique. Data source used is the social media Instagram account of Ministry and Non-Ministerial Government Agencies in Indonesia, such as @bekrafid, @kemdikbud.ri, @ristekdikti, @kemlu.ri, @kemenpar, @infobmkg, and @kemenhub151. The results found of this study were loanwords, loanblends, and loanshifts, also phonological, morphological, and lexical interference.

A Literature Review on the Effect of Perceived Organizational Support on Employee Engagement and Employee Performance of Government Agencies in Singapore, Thailand and Indonesia

The support of the organization where individuals work influences employees' quality of life in government agencies. Employee-perceived organizational support (POS) has been proven in previous research to help reduce employee stress levels and emotional exhaustion during work. The influence of POS in government agencies in Singapore, Thailand, and Indonesia shows similarities and differences. This research explores POS elements, namely Socio-emotional, Orientation towards organization and work, Behavioral outcomes, and Employee welfare, and its impact on government agencies in Singapore, Thailand, and Indonesia. The author uses a qualitative literature study approach; this research reveals POS elements practiced in government agencies in Singapore, Thailand, and Indonesia. The three countries theoretically use POS elements. However, in practice, their impact is very different, so the results of engagement and performance produced by employees are also different. The difference is that the POS implemented in Singapore and Thailand agencies contains a "behavior results" element, whereas in Indonesia, there is none. In Indonesia, nothing was found explicitly regarding the issue of cross-cultural citizenship behavior and employee withdrawal behavior. Furthermore, the POS measurement tool in the three countries uses the Survey of Perceived Organizational Support. The influence of POS fosters a positive work environment and can encourage employee satisfaction and work commitment. Therefore, agencies in Indonesia need to adapt it to increase employee engagement and performance

The obligation of academic staff at public universities to teach is subject to ordinances governing the obligation to teach adopted by the individual German Federal States (Länder). These ordinances stipulate the scope of the relevant obligation to teach. They are applicable both to staff who are directly employed by the Federal State and in cases where the relevant university is the superior authority (Dienstherr) and employer (Arbeitgeber). Recently employees representatives have been keen to make these teaching obligations the subject of collective agreement. This threatens to result in different regulations applying to civil servants (Beamte) and employees (Angestellte) at public universities. It is therefore necessary to look into the question whether such collective regulations would be permitted by law. Firstly, it is only possible to make private law employment relationships the subject of collective agreements, not, however, civil servant relationships. The obligation to teach of the employed members of the academic staff, as a specific form of the obligation to work, is in fact part of the substance of their employment relationships and can therefore, in principle, be the subject matter of collective agreement in accordance with Section 1 (1) of the German Act Governing Collective Agreement (Tarifvertragsgesetz). However, the question is whether the ordinances governing the obligation to teach are mandatory and would thus exclude any collective regulations in this regard. In terms of constitutional law, there is the further question whether an exclusion of collective regulations would be an infringement of the fundamental right of the freedom of association (Koalitionsfreiheit) as provided for in Article 9 (3) of the German Constitution and whether such infringement could be justified. Furthermore, it is necessary to clarify the legal situation in the case of universities having a capacity of their own as the superior authority and employer, because the relevant universities themselves are capable of being a party to collective agreement. And finally, specific provisions of the university laws as well may affect the question of whether collective regulations would be permitted in the area of the academic staffs obligation to teach, for example if it is possible under such specific provisions to determine regulations deviating from the Federal State ordinance governing the obligation to teach. The authors investigate these questions in the present article and come to the conclusion that collective regulations which deviate from the stipulations in the Federal State ordinances governing the obligation to teach would not be permitted by law, also to the extent that the universities themselves are the superior authorities and employers of academic staff.

THE INFLUENCE OF THE WHISTLEBLOWING SYSTEM ON FRAUD DETECTION IN EFFORTS TO ERADICATE CORRUPTION

This study aims to determine the influence of whistleblowing systems, professional expertise, fraud auditors on fraud detection on efforts to eradicate corruption in government agencies in Indonesia. Populace from the study is all forensic auditors in government agencies and private companies, while the sample used is 100 investigators in government agencies who have a whistleblower system in their agencies. The research method carried out was to analyze using PLS using five variables, namely Whistleblowing System (X1), Professional Expertise (X2), Fraud Detection (Z), and Efforts to Eradicate Corruption (Y). The results of the study from pls grouped the variables of whistleblowing system, professional expertise, fraud auditors influential and significant on fraud detection variables and also variables of efforts to eradicate corruption crimes, while fraud detection variables have an effect and are significant on efforts to eradicate corruption in agencies-instanthe government in Indonesia.

The Effect of Perceived Organizational Support on Employee Performance during Organizational Change with Affective Commitment to Change as Mediator

In facing the challenges of a world full of uncertainty, every organization needs to adapt to organizational changes. Employees as change targets need high motivation to be able to accept change. The success of an organizational change can be seen through the realization of employee affective commitment, which leads to increased performance during organizational change. This study aims to analyze the role of perceived organizational support on employee performance. In addition, to analyze the role of mediating affective commitment in the relationship. The object of research was carried out in the government sector by taking a sample of 128 respondents who are employees of the public sector organization, the Central Bureau of Statistics in Indonesia. Data collection was carried out through questionnaires distributed via email and social media. The research findings show that perceived organizational support does not directly affect employee performance. Meanwhile, affective commitment is a perfect mediator mediating the relationship between perceived organizational support and employee performance. Research is limited to the scope of one government agency only. Furthermore, research can be conducted in all government agencies in Indonesia to provide more comprehensive results.

Government institutions need social media channels as a public communication tool to disseminate policies, programs and public information. The government needs to use social media channels to reach a wider community amidst the low level of public trust in government communications and information channels. The aim of the research is to analyze the substance of the content, namely the type and nature of the content, what the audience needs and what the content message needs to communicate to the audience. This research also seeks the content structure related to how content is prioritized, arranged, formatted and displayed in the media. The objects analyzed are Instagram social media in 100 ministries and agencies. This research uses a descriptive quantitative approach that focuses on analyzing the use of Instagram social media by ministries and government agencies in Indonesia. This method aims to provide a comprehensive picture of government digital activities and to analyze the effectiveness of the substance and structure of the content implemented. Instagram was chosen as the main focus because it is the social media platform most widely used by ministries/agencies. The research results show that each agency has various needs with different strategies for using Instagram social media. The ministry has optimized Instagram social media more than the government agencies. Interestingly, the agency produces more content than the ministry, but it is still not optimal. Meanwhile, on average, ministerial agencies still prioritize personal figures and institutional agencies prioritize public information, although they also still predominantly prioritize leadership elements. The results of this research suggest that the government, especially the Ministry of Communication and Informatics, can create standards in managing social media, especially in producing the structure and substance of content so that it can more optimally convey information and interact with the audience.
