(Suggestion to improve animals' legal status in Korea)

Abstract

Korean Abstract: 현대에 이르러 반려동물에 대한 관심이 더욱 높아지고 있고, 반려동물 인구는 천만명으로 추산되고 있다. 그와 동시에 동물을 유기, 학대하는 등의 가혹행위도 더욱 늘어나고 있다. 누군가에게는 자연인과 대등한 지위의 가족으로서, 관심과 애정의 대상인 반려동물에 대한 잔인한 행위, 심지어는 생명을 박탈하는 행위가 이루어져도 우리나라 민, 형사법상 그에 상응하는 처벌, 보상을 받지 못한다는 여론이 들끓고 있다. 이러한 유기행위와 가혹행위의 기저에는 행정제도와 민, 형사법의 미비가 자리잡고 있다. 이에 반응하여 금년 3월 2일에는 동물보호, 학대와 관련한 개정안이 국회 본회의를 통과하였다. 그럼에도 불구하고 내, 외부적 가혹행위는 동물보호에 대한 공법과 형법적 제도가 체계적으로 자리잡히지 않는다면 근절되기 힘들 것으로 보인다. 동물보호법은 대한 학대행위의 방지 등 동물을 적정하게 보호, 관리하기 위해 필요한 사항을 규정함으로써 동물의 생명보호, 안전 보장 및 복지 증진을 꾀하고, 동물의 생명 존중 등 국민의 정서를 함양하는 데에 이바지함을 목적으로 한다고 하여 동물을 권리의 주체가 아닌 보호, 관리의 대상으로 보고, 법의 목적을 국민의 정서를 함양하는 것으로 하고 있다. 법과 언어, 그리고 제도가 일련의 생활방침을 규율하고 사회인식에 영향을 준다는 것을 고려한다면 우리나라가 동물을 대하는 자세는 시대에 비해 다소 소극적이다. 물론 동물을 보호하고 관리하는 것과 복지의 증진은 필요하겠지만, 진정 동물중심이 아닌, 인간중심으로 접근하여 대상을 바라보는 것처럼 보인다. 또한 동물보호법 외에 타 주요법에서도 동물은 단지 물건, 도구로 취급하는 등 기본적인 시스템 상에서 생명의 대한 존중이 결여된 것으로 보인다. 따라서 본고에서는 다른 나라의 경우 동물을 어떠한 지위로 보고 있는지 확인해보고, 동물에 대한 새로운 지위를 부여하는 제안을 해보고자 한다. English Abstract: In modern times, interest in companion animals is increasing, and the number of companion animal people is estimated at 10 million in Korea. At the same time, there are more and more harsh acts such as neglecting and abusing In modern times, companion animals are members of the family and are objects of interest and affection. However, there is a growing consensus that the Korean Civil and Criminal Laws do not receive the corresponding punishment and reward for depriving animals of cruel, even life-threatening acts. The basis of these neglecting and harsh activities is the lack of public law system, civil and criminal law. In response, on March 2 of this year, amendments related to animal protection and abuse were passed at the National Assembly plenary session in Korea. Nonetheless, internal and external cruelty seems unlikely to be eradicated unless the system of civil and criminal legal systems for animal care is systematically established. Purpose of Animal protection act is that by providing necessary information for proper protection and management of animals, including prevention of abuse of animals, purpose of animal protection act is that to contribute to protecting the life of animals, promoting security and welfare, and contributing to cultivating the emotions of the people, such as respecting the life of animals. It treats animals as objects of protection and management, not the subject of rights, and aims to cultivate the emotions of the people. Considering that laws, languages, and systems set of lifestyle policies and affect social perceptions, koerans' attitude toward animals is somewhat less than the times. Of course, it may be necessary to protect and manage animals and to promote welfare, but it seems to be approaching centrally human beings rather than In addition to the Animal protection act, other major laws of Korea treat animals as merely goods or tools, which seems to lack the respect of life. Therefore, in this article, I will try to find out what kind of status the animal is in other countries, and suggest a new status for the animal to Korea.
