Abstract

Abstract The legal principles involved where a right-line, surveyed, monumented and Torrens System boundary becomes gradually submerged either by tidal waters or by a moving natural watercourse (river or stream) are somewhat obscure. Does the upland parcel that the water has encroached upon now have a littoral or riparian boundary? Do any subsequent accretions attach to the now littoral or riparian land even where this may involve land included in another Certificate of Title? Where a land parcel is completely submerged, does the estate disappear altogether?
