Abstract

이 연구는 장애인 직업재활서비스가 장애인복지법, 동법 시행령과 시행규칙, 그리고 장애인복지 사업안내 등에 어떻게 규정되어 있는지, 관련 법적 내용은 서로 연계성이 있는지, 그리고 직업재활서비스의 법적 기반을 제고하기 위한 방안은 무엇인지 고찰하는 데 목적이 있다. 연구의 방법으로는 주로 관련 법령, 논문, 보고서 등에 대한 문헌분석이다. 이 연구의 결과는 다음과 같다. 첫째, 직업재활서비스는 장애인복지법에서 직업지도, 직업능력평가, 직업적응훈련, 직업훈련, 취업알선, 고용 및 취업 후 지도 등 6가지가 언급되고 있으나 동법 시행령이나 시행규칙에서 이러한 직업재활서비스와 연계된 내용을 찾기 어렵고, 전반적으로 볼 때 법적 기반이 취약하다. 직업재활서비스는 대부분 장애인복지법 시행규칙의 [별표 4,5]와 장애인복지 사업안내에서 제시되고 있으나 시행규칙과 사업안내는 내용의 연계성이 있다기보다는 유사성이 높은 것으로 볼 수 있다. 이 연구에서는 연구결과를 바탕으로 법령에서 직업재활서비스의 개념 및 내용 명료화 등 직업재활서비스의 법적 기반을 제고하기 위한 5가지 방안을 제시하였다.The purpose of this study is to examine how the vocational rehabilitation service for the disabled is defined in the Act on Welfare of Persons with Disabilities, the Enforcement Decree and the Enforcement Rules of the same Act, the Disability Welfare Service Guidelines, and the legal contents are relevant and enhance the legal foundation. As a method of research, literature analysis was mainly conducted on related laws, research papers, and reports, and the results of the research were as follows. First, vocational rehabilitation services were referred to in the Act on Welfare of Persons with Disabilities as six categories, such as job guidance, vocational competency assessment, job adaptation training, job training, job placement, employment and post-employment guidance, but have little connection with the Enforcement Decree or the Enforcement Regulations. Most of the vocational rehabilitation services are provided in [Appendix 4 and 5] of the Enforcement Rules and the Service Guidelines to welfare for persons with disabilities, but the Enforcement Rules and Project Guidance can be said to be almost similar rather than linked. In this study, based on the research results, five recommendations were proposed to enhance the legal foundation of vocational rehabilitation services, including the fact that the concept and contents of vocational rehabilitation services should be more clearly presented in relevant laws and regulations.
