Abstract

This part analyses Article 82 of the EU Regulation on Insolvency Proceedings (EIR), which explores the location of the data storage of personal data. It details the storage of personal data relating to data subjects in the national databases operated by the Member States or other bodies. It also points out that the storage of personal data is considered one aspect of the cardinal concept of ‘data processing’. The part describes Article 82 as a response to the European Data Protection Supervisor’s recommendation that required the specification of whether data would be stored in the e-Justice Portal and what specific safeguards were to be utilised. It declares that no personal data will be stored in the e-Justice Portal system that was introduced by the recast EIR.
