Abstract
In recent times the defence purchase deal for Rafale combat flights by Indian Government became a seriously controversial issue ever since the principal opposition party suspected a big scandal worth thousands of crores of Rupees. There was a public interest litigation seeking direction from Supreme Court to probe the deal. This was rejected by the full bench of Supreme Court. Alleging suppression of information, misleading the judiciary the PIL was filed based on certain leaked documents seeking review of the decision. During the arguments the Government represented the Supreme Court that petitioners should be prosecuted for stealing the ‘secret’ documents. Then the judges questioned the government about conflict between right to information and official secrets protection. Whether secrecy continues as a legal cover when Right to Information Act guaranteed the access? This article is an attempt to answer the question.
