Abstract

The present annotation analyses the General Court judgment of 10 May 2016 (Third Chamber) in case T-47/15 Federal Republic of Germany v European Commission. After first discussing the background of the case, it focuses on the main arguments put forward by the parties: the German authorities against the decision and Commission’s for it, and the reasons for the judgment the Court finally reached. After describing the Court’s reasoning, the annotation comments on certain findings pertaining particularly to the notion of ‘State resources’.
