Abstract

The curator of the estate, who is established to exercise custody of an unincorporated estate, may also institute proceedings before an administrative courts or join proceedings that are already pending. The curator of the estate retains the right to remuneration for his action. Therefore, it is important to determine the rules on the basis of which it can be granted. The law on proceedings before administrative courts can not constitute grounds for awarding of such a remuneration. In this respect, the procedural provisions on granting remuneration to the curator of the estate in proceedings before common courts are also not applicable. All in all, it is crucial to determine which provisions in the legal system may be taken into account for the correct award of remuneration to the curator of the estate for the actions taken before the administrative court.
