Abstract

This chapter assesses the damages provision in the Remedies Directives. It discusses the judicial interpretation thereof and the application of the general court-developed doctrines of EU law, notably ‘procedural autonomy’, effective judicial protection and Member State liability. It provides a critique of the Combinatie Spijker Infrabouw CJEU case and presents an argument in favour of a separation thesis of effectiveness and Member State based damages.
