Abstract

Abstract This chapter examines the key sources of natural resources law, namely, international law (ie World Trade Organization (WTO) and international trade law, multilateral environmental agreements (MEAs), international investment laws); regional and domestic laws; judicial decisions; and scholarly publications. Secondly, established general principles governing natural resources development, such as permanent sovereignty and jurisdiction over natural resources; the do-no-harm principle; sustainable resource development and intergenerational equity; just transition (PANEL Principles); and the principle of cooperation (solidarity), are examined to map their evolving conceptualization in light of the ongoing global energy transition. With emerging sovereignty, security, and solidarity challenges associated with the ongoing energy transition, this chapter discusses the need for the fundamental reimagination and (re)design of the instrument mix of natural resources law to address regulatory fragmentation and enhance coherence in the design and implementation of net zero efforts.
