Abstract

The presente work intends to define the juridical and political causes of judicialization of public policies aimed at achieving human rights, through analysis of the state theoryelements, political science and the constitutional jurisdiction as well as the impacts for the financial law. Therefore, seeks to analyse groups of pressure, representative crises and the political legitimation of Judicial Power. After this first approach, the work intends to analyze the influence of Neoconstitutionalism on constitutional law standardsand the reach of fundamental rights are receiving through the Judicial Power and the doctrine of law. Then, the work demand to systematize the financial impacts of judicialization of public policies for the financial law.Intends to unite all these assumptions and conclusions through an analysis juridical and political of their meaning.
