Abstract

Ill-written laws damage the reputation of the law and of the rule of law. They discredit the legislature and force the practitioners of the law to make decisions based on laws that, because they are so poorly written, are not met with respect. To accuse addressees of such laws, who transgress them, of a lack of adherence to the norm and disobedience to the law is only possible with a bad conscience. Sections 184i and 184j of the German Criminal Code (StGB) are two showpieces of recent legislative work which, as they are, should not to have seen the light of day. In the following, the list of defects which can already be found in commentaries on the StGB and other publications is extended by several points.
