Several Ponderings on Modifying Chinese Law on the Protecting of Wildlife

Abstract

Law of the People’s Republic of China on protecting the wildlife issued in 1988 was far fallen behind the present need to a large extent. Though it was modified on August 28, 2004, it still limited its objects on rare and endangered wildlife, the protection of common wildlife being neglected, the wildlife as the resources being overemphasized. At the same time there are serious deficiencies in its enacting purpose. And the author thinks that the key to modify this act completely is to re-establish the enacting purpose. And the principle of respecting the living rights of wildlife and protecting the wildlife completely should be established. The protecting objects of this act should be enlarged. And the ecological compensation mechanism of wildlife resources should be modified and improved.
