Abstract

The issues of secession and of international legal assessment of secessionist acts hang upon the Kosovo Advisory Judgment of the International Court of Justice (ICJ). This chapter starts with some fundamental reflections on the international legal problems of with a particular emphasis on the paradigm of secession, and elaborates some more detailed ideas on the preconditions and the extent of secession.t The second part follows up with some notes on the specific case of Kosovo, in particular as far as Security Council Res. 1244 and its legal consequences for the stakeholders in Kosovo are concerned. The chapter discusses the central weaknesses of the ICJ Advisory Opinion, and ends with a summary of the author's reflections with a short resume on the legal status of Kosovo. Self-determination of peoples and territorial integrity of states must be balanced against each other in a sensible way.
