Abstract

The African Charter on Human and Peoples' Rights (ACHPR) possesses a number of peculiarities one of which is the degree of detail that is given to the provisions on the duties of the individual. The ACHPR is not the only human rights instrument that touches on the issue of the duties of the individual; various other human rights instruments such as the Universal Declaration of Human Rights (UDHR), the American Declaration on the Rights and Duties of Man. The complimentarity of rights and duties is very much emphasized in the African traditional society. This brings to the fore the Hohfeldian analysis of rights and duties as correlatives. According to his theory, for every right that somebody asserts there must be a correlative duty in some other person or persons. On any issue relating to duties it is necessary to call into question the mechanisms for enforcing the duties.
