Abstract

On 16 July 2020, the European Court of Justice (‘ECJ’) issued its judgment in Data Protection Commissioner v. Facebook Ireland Limited, Maximillian Schrems C-311/18 (‘Schrems II’). The case concerned a request for a preliminary ruling by the ECJ pursuant to Article 267 of the Treaty on the Functioning of the European Union (‘TFEU’) made by the Irish High Court. The reference was made in respect of a longrunning complaint made by Mr Schrems to the Irish Data Protection Commissioner in 2013 concerning the transfer of personal data by Facebook Ireland Limited to its parent company, Facebook Inc, in the United States of America (‘US’).
