Abstract

This chapter explores the significance of the rule of law (RoL) crisis for the growth of the constitutional ‘awareness’ of the European Union. Focusing in particular on the most recent entries to the RoL toolbox, it is noticed how EU institutions reacted to this crisis setting up a complex ‘value protection system’ that allows the EU’s constitutional dimension to develop further. At the same time, the paper insists on the need to go beyond the ‘Eastern European prejudice’ and to distinguish more accurately the different positions of the so-called new democracies.
