Abstract

Thai Abstract: หากความคดของยคสมยใหม (modern) ซงเปนชวงหลงการปฏวตอตสาหกรรม ทำใหสงตางๆถกกำหนดภายใตหลกเกณฑและทฤษฎ แตยคหลงสมยใหม (postmodern) กลบตรงกนขาม กลาวคอ เปนยคทเนนเสรภาพและอสระของบคคลไมเชอเรองความเปนสากลเพราะเชอวาแตละคนแตละวฒนธรรมนนมเหตผลของตวเอง สงทดทสดสำหรบคนหนงไมสามารถนำมาตดสนวาดสำหรบผอน ดงนนในยคหลงสมยใหม (postmodern) กฎหมายจงไมควรทำลายหรอลดคณคาความเปนมนษยหรอทำใหศลธรรม จรยธรรม และแนวทางปฏบตของคนในสงคมเสอมถอยลง รวมทงไมควรยดถอเฉพาะ “แบบ” ของกฎหมายอยางเครงครด ตายตว จนบบคนทางสงคมเกนกวาทจะชวยควบคมใหสงคมเปนระเบยบ ในขณะเดยวกนกฎเกณฑของกฎหมายทสรางจากปทสถานของคนในสงคมเปนสงสำคญทสามารถพฒนาและสงเสรมใหกฎหมายมประสทธภาพ โดยเฉพาะอยางยงบทบาทของกฎหมายอยางออน (soft law)ทไมมสภาพบงคบ เพอกอใหเกดการพฒนารปแบบของกฎหมายในยคหลงสมยใหม (postmodern) โดยการขยายความเขาใจ“รปแบบของกฎหมาย” ใหมความหมายครอบคลมกวางกวาความหมายของกฎหมายทวากฎหมายตองเปนคำสง มสภาพบงคบ และมบทลงโทษเทานน ซงในประเดนนอาจกอใหเกดการพฒนากฎหมายในอนาคตใหยงยนควบคไปกบการฟนฟศลธรรมไดEnglish Abstract: The legal concept in the modern period after the industrial revolution is defined by the rules and theory, but it is opposite in postmodern period, which emphasizes on liberty and freedom of individual that is not a universal belief. This is because the concept in this period is based on the belief that each individual and each culture has its own reasons and the best option for one person may not always be regarded as the best option for others. Therefore, in the postmodern period, the law should not ignore or deteriorate human values or undermine moral, ethical, and social practices of the public. In addition, the law should not strictly adhere to the specific legal pattern, which should result in social oppression and more than necessary to control the social order. Therefore, the law which has no binding effect, penalties and originates from norms (norms) of people in the society is also called soft law in English: the question arises of whether such soft law should be regarded as the law; by taking into account of the hierarchy of law, whether such soft law can be considered as part of the law; whether such soft law can be develop in accordance with current social context; and how can it be achieved.
