Abstract
On 1 January 2022, the German bishops put into force a regulation for the handling of the personnel files of the clerics in their dioceses (Personalaktenordnung PAO). In doing so, they implemented one of the recommendations of the MHG-Study. First, this article examines the rights and obligations of “employees,” the “employer” and third parties in relation to clerics’ personnel files. Second, it offers answers to the following questions: (no. 1) whether the PAO fulfils the purposes set out in its preamble and (no. 2) whether the principle of legal equality with other comparable regulations is fulfilled.
