Abstract

Abstract This chapter explains the right to lodge a complaint with a supervisory authority in accordance with Article 52 of the EU Law Enforcement Directive (LED). It explains how the right to lodge a complaint with the supervisory authority is a significant addition to legal remedies a person has available to find redress against the data protection rules infringements. In comparison to judicial remedies, lodging a complaint with a supervisory authority entails less administrative burden. However, the competencies of the supervisory authority are limited. The chapter then details the complaint procedure, which is, in principle, left to the procedural autonomy of Member States, before considering the territorial competence of supervisory authorities.
