Review of social security administration in a risk society

Abstract

우리 헌법 제34조 제1항은 ”모든 국민은 인간다운 생활을 할 권리를 가진다“라고 하여 국민의 생존권을 규정하고 있고, 동조 제2항은 사회보장·사회복지의 증진에 노력할 국가의 의무를 정하고 있다. 그리하여 국가는 현실적으로 대두된 사회적 요구를 충족하기 위하여 사회문제의 해결을 위한 조정자로서 또는 종합적인 사회보험자로서 적극적으로 대처하여 국민의 생활보호 내지 사회복리의 향상을 도모하지 않을 수 없게 되었다. 사회보장기능은 시대적 요청에 따라 등장한 복리국가에 있어서 공공복리증진의 사회적 분야의 적용이다. 이러한 국가책무를 실현하기 위한 구체적 수단이 바로 사회보장행정이다. 사회보장행정은 국민의 최저생활을 보장하고 복리를 증진하기 위하여 개인에 대하여 공적 급부를 제공한다. 본고에서는 사회보장행정을 리스크와 관련하여 검토하였다. 먼저 사회보장의 기본개념, 일본의 사회보장행정에 있어서 요보장사유, 비용의 부담방식, 정치적 결정, 관리행정 등을 검토하고, 우리나라의 사회보장행정에 있어서 사회보장행정의 개념, 사회보장의 영역으로 사회보험, 공공부조, 사회서비스의 문제점과 개선점을 검토한 후 우리나라 사회보장행정 제도의 개선방안을 위한 시사점을 찾아보았다.Article 34 Clause 1 of our Constitution stipulates the people s right to live by saying, “All people have the right to live a decent life,” and Article 2 of the Ties sets out the state s obligation to strive for the promotion of social security and social welfare. Thus, the state was forced to actively cope with social problems as coordinators or as a comprehensive social insurer in order to meet the social needs that have emerged in reality, thereby promoting the protection of the livelihood of the people and the improvement of social welfare. These social security functions are the application of the social sector of the promotion of public welfare in a welfare state that emerged at the request of the times. Social security administration is the specific means of realizing these national responsibilities. Social security administration provides public benefits to individuals to ensure the minimum living of the people and to promote welfare. In this paper, social security administration was reviewed in relation to risk. First, we reviewed the basic concepts of social security, reasons for the need for social security, cost, management, political decisions, and management administration through the discussion of social security administration in Japan, and reviewed the problems and improvements of the nation s legal system before looking for implications for the improvement of the nation s legal system.
