Abstract

Under current NLRB rules, a union is required to serve an election petition on the employer prior to its being filed with the labor board. In such instances, there is nothing that an employer need do. As a matter of practice, within the next day or two, an official copy of the filed petition with an assigned case number will be received by the employer directly from the NLRB. The communication from the NLRB starts the legal process leading to an election.
