Abstract

“The new [CPR] rule 3.9 is intended to introduce a culture of compliance, because that is necessary to promote access to justice at proportionate cost. It is not intended to introduce a harsh regime of almost zero tolerance, as some commentators have suggested.” (per Jackson LJ in Denton v TH White Ltd, Decadent Vapours Ltd v Bevan [2014] EWCA Civ 906 [2014] 1 WLR 3926 at [96])
