The European legal framework has historically paid attention to personal data. The Directive 95/46/EC “On the protection of personal data” defines as such any information that could be used to identify a person and stated the obligation of every controller to obtain consent before collecting, processing, and/or using any personal data1. With the innovations brought by globalization, technology, and digital evolution, many controllers moved their servers “offshore”, which coincides with a smaller control space for legal entities regarding the treatment of personal data at their disposal.
