Abstract

Course Overview: This course will analyze in detail the legal structures of regional trade agreements (RTAs), including but not limited to NAFTA. It will review GATT Article XXIV and the economic and policy debate over the spread of RTAs and global vs. regional trade arrangements; discuss key aspects of NAFTA, including tariff elimination, rules of origin, intellectual property, services, the environment and settlement of investment and other disputes, often on a comparative basis with more recent U.S. FTAs. It will also analyze legal and policy issues relating to the Chile and Central American – Dominican Republic – United States FTA, the Southern Cone Common Market (MERCOSUR), the ASEAN Free Trade Area (AFTA) and the Southern African Customs Union (SACU) and a number of other RTAs. At least one Amock@ investment arbitration exercise is contemplated. Attention will be given, inter alia, to developing U.S. trade policy issues affecting RTAs and to the long-standing dispute between Mexico and the United States over cross-border trucking services.
