Abstract

Although the National Labor Relations Board has in a number of cases found discipline or termination of employees for their Facebook postings and comments to be unlawful, in a new decision the Board said employers may lawfully terminate employees whose Facebook postings indicate an intention to engage in insubordination (Richmond District Neighborhood Center, 361 NLRB No. 74 (2014)).
