Abstract

In the global climate after September 11, concerns about the preservation of national security have been heightened. This paper examines how the inevitable tension between national security and individual rights has played out in the courts and in the new immigration legislation in New Zealand. Three areas are concentrated on: access to classified information, detention and non-refoulement obligations.
