Abstract

The author analyzes the changes of the year 2020 against the background of the fundamental structure of the Russian Constitution. He identifies various developments leading to a breach of the Constitution. For example, the amendment of Article 81 is a clear lex Putin; the main purpose being to allow Putin to stay in power until 2036. The amendments put into question fundamental principles of the 1993 Constitution. The amended Constitution also installs a double state in Ernst Fraenkel’s sense, in which “state of measures” and “state of norms” face each other. The amendment process was a mockery of the Constitution and ultimately of the Russian people. There is hope, however, that after the end of Putin’s rule, the president’s visible superiority in the constitutional structure will be contained again.
