Abstract

The patent-examination system can borrow concepts from securities law: Through administrative rulemaking — and without the need for statutory changes — the USPTO could offer applicants the option to fast-track their applications and receive a convertible, low-end patent (CLEP) that (i) has fewer rights than a standard patent, but (ii) can later be converted, within limits, to a full-blown patent.
