Abstract

In 2019, Article 306a was added to the 1997 Criminal Code. It provides for a new type of offence, that is, odometer fraud in the form of altering the odometer reading or interfering with its operation or ordering another person to do so. The purpose of the new provision is to punish the preliminary behaviors aimed at fraudulent sale of a vehicle, which has become a serious public problem over the years. The very idea of criminalizing such conduct is laudable, but if one considers the details, it can raise doubts about the individual forms and features of the offence, and possibly practical difficulties in holding a person accountable for such behaviour.
