Abstract

The article deals with the providing of free professional legal aid to convicted persons. The sources of law, which contains the following right of convicted persons, were analysed, and also the mechanism of its realization in practice was researched. The situation with the ensuring of the right to free legal aid for the convicted persons on the example of Mykolaiv, Odesa and Kherson oblasts was analyzed. The authors came to the conclusion, that even though the researched right is proclaimed by a range of law sources, it is not available for all the categories of persons. Only those convicted persons, who are either the soldiers, convicted to placement in disciplinary battalion, either the persons, convicted to such kind of punishments as the restriction of liberty or imprisonment, can rely on free legal aid in Ukraine. The authors described in details the difficulties on the way to receiving free legal aid from the state, which are faced by the convicted to imprisonment persons.
