Abstract
In the Republic of Paraguay, indigenous peoples are victims of racial discrimination; the one that is accentuated in relation to those that are deprived of liberty in the national penitentiaries. It is for this situation that in 2018 the Ministry of Justice approved the Action Protocol for indigenous persons deprived of liberty (Protocol). The work aims to investigate the Protocol of action for indigenous peoples deprived of liberty of the Ministry of Justice of 2018, in order to analyze whether it is appropriate or not to the autonomous rights of indigenous peoples. Regarding the methodology, the focus is qualitative, non-experimental and cross-sectional design through a detailed and documentary study of the Protocol in light of the Constitution and international human rights law. Although the Protocol constitutes a sound legislative decision, it lacks in terms of regulation according to the interdependence of human rights. On the other hand, regarding legislative technique, the Protocol could be more operational than programmatic in order to become a direct source of indigenous rights.

Es sabido que las personas privadas de libertad en Paraguay sufren condiciones infrahumanas de supervivencia que se proyectan en la violación sistemática de todos y cada uno de sus derechos humanos y libertades fundamentales acompañada de una fuerte estigmatización, prejuicios y desprecio hacia ellas, aspectos que, de manera general, se estudian y se analizan permanentemente, por organizaciones no gubernamentales, organismos internacionales de protección así como por instituciones del Estado paraguayo
Es importante resaltar en cuanto a estos derechos; la práctica religiosa, la lucha contra la alineación cultural, así como el sentido de pertenencia étnica que se observa en las personas indígenas privadas de libertad a través de la firme convicción de contar con pabellones solo para indígenas (Galeano Monti, 2018)

Protocolo de atención a personas indígenas privadas de libertad. En la República del Paraguay, las personas indígenas son víctimas de discriminación racial; la que se ve acentuada en relación con aquellas que se encuentran privadas de libertad en las penitenciarías nacionales. Es por esta situación que en el 2018 el Ministerio de Justicia aprobó el Protocolo de actuación para personas indígenas privadas de libertad (Protocolo). El trabajo se propone indagar el Protocolo de actuación para personas indígenas privadas de libertad del Ministerio de Justicia de 2018, a los efectos de analizar si el mismo se adecua o no a los derechos autónomos de los pueblos indígenas. En cuanto a la técnica legislativa, el Protocolo podría ser más operativo que programático a fin de constituirse en una fuente directa de derechos indígenas
