Abstract

The authors examine the problems of protecting the rights of crime victims in cases of their death. The analysis of court practice allowed the authors to identify two typical situations in which the necessity of ensuring the protection of rights arises: firstly, if the victim dies as a result of the crime and secondly, if the affected person, recognized as the victim, dies due to reasons unconnected with the crime. The authors note the insufficiency of the legal regulation in the first typical situation and the lack of normative regulation in the second one, which results in the diversity of court practice and hinders the protection of the rights of a deceased victim. Based on the conducted research, the authors developed a number of suggestions aimed at resolving the identified problems of protecting the rights of a deceased crime victim.
