Abstract
The paper explores the ‘legal frontier’ area of Protected Cell companies. Legislation relating to this new type of company is becoming widespread and the concept is attracting very substantial funds. The concept raises difficult new questions connected with insolvency and enforcement of the concept in England and other countries which do not have the concept. The subject has not been considered yet by the courts and poses considerable challenges in terms of legal analysis.
