Abstract

This article presents a proposal for amending the contents of Article 106(1) and Article 110a(1) of the Penal Enforcement Code. The amendment is justified by the need to eliminate various expressions referring to the same designata contained within one legislative instrument. The use of the proposed expression: ‘objects of a religious nature’, in the normative sphere will more effectively secure the convicted person’s right to possess specific objects whose value and significance increase in the conditions of penitentiary isolation. Moreover, the possibility of controlling and limiting the convicted person’s right to possess certain objects will be maintained, given the purposes of serving a penalty of imprisonment as well as safety of the penitentiary facility.
