Abstract
Promopen Australia Pty Ltd purchased 60,000 red plastic disks and 60,000 purple plastic disks from Fuyang Import and Export Co Ltd, at the total price of $27,600 with the FOB at Shanghai. They agreed that the goods were to be delivered according to the samples, and the delivery time was 30 days after the sample confirmation by Promopen Australia Pty Ltd. On November 26, 2005, Fuyang Import & Export Co Ltd sent nine plastic plate samples with the printed logo to Promopen Australia Pty Ltd. After the samples were confirmed by Promopen Australia Pty Ltd, Fuyang Import & Export Co Ltd went into production and shipped the goods on December 26, 2005.
