Abstract

The purpose of this work is to analyze the legal regulation of the relationship between a job seeker and an employer in providing information in connection with checking a candidate for compliance with the advertised vacancy. It has been established that the legal regulation of these relations is not complete, does not take into account a number of issues that arise in practice, and therefore there is a widespread violation of the rights of job seekers to privacy, protection of personal information, the disclosure of which by the employer is the cause of discrimination against job seekers for various reasons . It is concluded that obtaining personal information about a job seeker for purposes contrary to the law, including with the written consent of the job seeker, is illegal. Possession of information about the personal life of an applicant allows employers to refuse to conclude an employment contract on discriminatory grounds, legally formalizing the refusal correctly.
