Abstract

Objective: to explore scientific and practical approaches to regulating the circulation of information on the Internet in the context of information security of the state. Research methods is based on the methods of documentary analysis and synthesis, comparative analysis, objective truth, which allowed to systematically trace the approaches to the registration of Internet media. Results: it is stated that the European legal tradition does not consider the regulation of the circulation of information on the Internet a priori as a measure that violates freedom of speech. Provided that it is properly regulated (in accordance with the requirements of the Convention for the Protection of Human Rights and Fundamental Freedoms), such regulation, on the contrary, strengthens journalists’ guarantees and expands the range of information to which the presumption of authenticity can be applied. dissemination of inappropriate information. Discussion: as there is no public consensus on the regulation of information circulation on the Internet, it is proposed to emphasize the voluntary registration of Internet media in the form of news agencies, which is currently practiced. However, registered Internet resources should receive preferences in the form of legal guarantees of trust in the information disseminated by them. Article 35 of the Law of Ukraine «On Information Agencies» and Article 42 of the Law of Ukraine «On Printed Mass Media (Press) in Ukraine» should be supplemented with reservations that the presumption of accuracy of information applies only to information obtained from registered Internet media. This will increase interest in such voluntary registration. It is also recommended that registered online media outlets post information about their official registration as a news agency on their own website, which will increase the level of trust in the information they disseminate.
