Abstract

The gloss concerns the judgment of the Provincial Court in Świdnica, which faced a relatively frequent factual state of opening a bank account and then disclosing its data to a third party who performs fraud through it. The Provincial Court in Świdnica, following the court of first instance, rightly attributed the aid to fraud. This position is correct, but it is against this background that some specific remarks should be made, which will be presented in the commentary.
