AbstractIn the legislative system, Pancasila is a basic norm (staatsfundamental), which successively then verfassungnorm UUD 1945, grundgezetznorm or MPR provisions, and gezetznorm or the Act. The decision is part of the implementation of the authority of the Constitutional Court which has 4 (four) authorities and 1 (one) obligation as stipulated in Article 24C paragraph (1) and paragraph (2) of the 1945 Constitution. Namun dalam kenyataannya, Pancasila disamakan kedudukannya dan disejajarkan dengan UUD 1945, Negara Kesatuan Republik Indonesia, Bhinneka Tunggal Ika yang kemudian disebut dengan istilah Empat Pilar Berbangsa dan Bernegara. Mahkamah Konstitusi sebagai lembaga penjaga gawang konstitusi mengembalikan kedudukan pancasila sebagai dasar negara melalui Putusan Mahkamah Konstitusi Nomor 100/PUU-XI/2012. Putusan tersebut merupakan bagian dari pelaksanaan kewenangan Mahkamah Konstitusi yang mempunyai 4 (empat) kewenangan dan 1 (satu) kewajiban sebagaimana diatur dalam Pasal 24C ayat (1) dan ayat (2) UUD 1945. Selain sebagai lembaga negara pengawal demokrasi, Mahkamah Konstitusi juga sebagai Pelindung dasar negara dan sumber hukum.
