Abstract

Will the Claims in respect of Loss or Damages arising from Competition Infringements (Competition Act 1998 and Other Enactments (Amendment)) Regulations 20171 have an impact upon private damages actions in the UK? The aim of the EU Damages Directive2 was to encourage consumers and businesses to claim damages or compensation following harm caused by infringements of competition law. The UK Regulations brought in on 9 March 2017, implements the EU Directive into UK law; however, will these Regulations have an impact upon private damages actions in the UK?
