Abstract

This work focuses on the study of the principle of mutual recognition and cooperation, the result of the effort of the European Union to achieve an area of freedom, security and justice. To this end, numerous legal instruments have been created, which turned out to be fragmentary and dispersed. This necessitated a new approach based on mutual recognition of criminal decisions in cases with a cross-border dimension. This is achieved through a new legal cooperation model, based on mutual trust, the use of uniform forms and the way the Member States interact.
