Abstract

Price alignment coordination is the only price listing conduct that involves debate over (1) acceptance or not of suggested prices; (2) low interest in suing individuals involved and (3) erratic standard of proof applied to the definition of market power (per se X rule of reason). When not limited to suggested prices, price listing often includes cartel agreements between the member corporations or individuals. Hereinafter we offer an insight on how Brazil’s Council for Economic Defense (CADE) addresses price alignment coordination carried on by associations, recent trends in the rulings of the Commission and bring along the approach we believe is more appropriate pursuant to the international experience, Brazil’s legislation and the antitrust economic history.
