Abstract

Patent infringement damages are often related to the contribution of the patent to the infringing product. Estimating that contribution can be difficult, particularly for complex, rapidly changing products. There is, however, a substantial body of research by government statistical agencies devoted to determining price changes associated with changes in product characteristics for just such complex products – —hedonic analysis for price indexes. This article lists analyses available in different countries and presents an example of how one such analysis might be applied. Such research may provide useful guidance in valuing patents' contributions.
