Abstract

In Reply.— In my response to Dr Crumrine, I stated, company policy should be developed with physician input and full consideration of [EEOC] regulations and EEOC decisions on similar cases. The employer has full responsibility for the safety and health of the worker in the workplace. Therefore, the company should have a policy on the placement of employees in the workplace. I further stated, decision on waiving restrictions for the employee on the application for employment with a definite inguinal hernia and a moderate-sized defect rests with the examining physician who should be guided by company guidelines. I agree that a physician should not permit nonmedical considerations, especially laws that are directed to the employer, to modify his medical judgment; however, the physician should not function in a vacuum, isolated from the rules and regulations of society.
