Abstract

The problem of infertility is not new in India. It is a worldwide problem. The Assisted Reproductive Technology (ART) is very helpful to tackle the problem of infertility. An infertile woman or a childless couple who desires to have their own baby can fulfill their desire by arranging a surrogate mother. The practice of surrogacy is also not new in India. It has been in practice in different forms from ancient India. In modern India, due to the development of science, the practice of surrogacy has become common here. Simultaneously, it has generated a number of issues and problems. Sometimes, it leads to crimes like abandonment of child born out of surrogacy, exploitation of surrogate mother etc. Irrespective of a number of issues, surrogacy is a ray of hope for the childless couples. In India, there is no legislation till now to regulate the practice of surrogacy. There is need of legislation to regulate the surrogacy particularly the rights and duties of the intending parents, surrogate mother and born out child. Now, the Surrogacy (Regulation) Bill, 2016 has been introduced in Parliament of India. The purpose of this research paper is to study the various issues generated from surrogacy. The Surrogacy Bill will also be studied and suitable suggestions will be submitted. The doctrinal method of study will be used to complete this research paper.
