Abstract
Healthcare assistants are being called to testify as witnesses of fact in cases from registration of premises to withdrawing and withholding life-sustaining treatment. Recent rulings have also considered misdiagnosis of vegetative state for minimally conscious state. The role of ‘hands on’ staff will also develop as the Mental Capacity Act 2005 becomes more recognized and has implications for the monitoring role of the Public Guardian.
