Abstract

The article deals with the issues of unification of the norms of civil procedure and arbitration procedure on certain issues that arise when considering cases of challenging legal acts. Analyze the current legislation and law enforcement practice on the issue of consideration by the court of substantive legal requirements together with requirements arising from administrative and other public relations was made. The article consistently argues for the need for legislative consolidation of the possibility of joint consideration by the court of related requirements of a public and private legal nature. The conclusion is that it is expedient to consider the claims for damages together with the requirement to declare a legal act invalid (in whole or in part), which have the purposes of procedural economy and optimization of the burden on the judicial system.
