Abstract

The current Islamic transactions practice in Malaysia was implemented on July 1, 1983 with the establishment of Bank Islam Malaysia Berhad. It is a turning point for the Malaysian people, especially Muslims, since for the first time, Islamic transactions without usury, gambling and gharar (uncertainty) are implemented in the banking sectors. However it cannot be denied that knowledge and practices of Islamic transactions among the community increased through research and related studies. This article is to review the literature related to the fatwā of Islamic transactions and the use of maqāṣid al-Sharī‘ah that will be studied descriptively using library research and documentation methods. The study found that the use of maqāṣid al-Sharī‘ah has been written in various languages, aspects and applications. However, no studies have been carried out related to fatwā on Islamic transactions in Malaysia.
